The Electronic Communications Code is often overlooked when you enter a lease with a telecoms operator and once a lease is entered, the code gives operators rights to retain their equipment and you as the landlord cannot easily enforce removal of equipment.
The 2017 Digital Economy Act or reform of the Electronic Communications Code gives operators enhanced powers to upgrade, share and assign their leases with little or no reference to land and property owners. It also changes the method of valuation of how rents will be assessed in the future.
Chris Hicks has been extensively involved with the reform of the Code and advising government and DCMS from a landlord’s perspective. He can offer clear and high-level advice to landlords contemplating entering into agreements with the telecoms operators under this new code regime.
