More options for clients with small development sites

Today the Court of Appeal has upheld the Government proposal to exempt small development sites from affordable housing contributions.  This will apply to developments of 10 dwellings or fewer, or 1,000 square metres or less. In designated rural areas, including National Parks and AONBs the threshold is reduced to 5 dwellings.

This is a major step forward for clients with small development sites who will now have more viable options where they had previously been within the threshold for affordable housing.  Derbyshire Dales, for example, previously had a policy which triggered affordable housing payments of over £30,000 for even a single residential conversion. 

Kay Davies, Head of General Practice Planning, commented: “Whilst there might be a reduction in affordable housing delivered on eligible sites, the result of this ruling will almost certainly be an increased number of applications for small housing sites and in turn an increase in housing land supply – a key objective of Government policy.”

There is a small possibility of a further appeal to the Supreme Court if West Berkshire and Reading Councils, who challenged the Government on this matter, have the appetite.  In the interim, the window is open for clients to maximise this relief on affordable housing requirements, which will hopefully remain unchallenged.
