Planning Bill receives Royal Assent

Planning Bill

The Bill received Royal Assent on 12 May 2016. In getting to this point the Bill has experienced a convoluted battle between the Commons and Lords over technical changes to the wide ranging proposals. The Bill been severely criticised in both Houses of Parliament because of the lack of detail, with much left to subsequent regulation. At present we do not know what will be in the regulations; they will depend on further consultation exercises.

The Housing and Planning Act, as it is now called, introduces a range of changes to the planning system, including a requirement for councils to provide 20% of new housing as discounted starter homes for first-time buyers.  

Another key measure would introduce ‘permission in principle’ – an automatic consent for sites identified in local and neighbourhood plans and new brownfield registers subject to further technical details being agreed by authorities.

Further provisions would allow the Secretary of State to intervene in local plan preparation and measures to boost self and custom build housing.

When the Bill was published, the government said it would kick-start a "national crusade to get one million homes built by 2020". However, the Government’s focus remains on the delivery of new homes, leaving much of the detail to regulations which are still to be consulted on. This raises doubt over whether the Government will be able to achieve its ambitious target, given the significant shortfall in delivery which persisted in the last year.

It is understood that further planning reforms which are expected to be announced in the Queen’s Speech this week.
