Planning success at appeal for Lloyds Pharmacy in Bicester

The Fisher German planning team have again proved their deserved reputation for success in winning appeals where a planning application had been refused.
 
The team were approached by Lloyds Pharmacy who were hoping to make some alterations to one of their shops located within the historic centre of Bicester in Oxfordshire. They were proposing to remove the existing shop front and install a more contemporary frontage more suited to a modern retail experience.   
 
The Pharmacy itself was constrained by its location within Bicester’s historic centre which is designated as a Conservation Area and was also in close proximity to several listed buildings.  
 
We worked with Lloyds Pharmacy to produce a design that respected its historic surroundings whilst reflecting the progression of the Lloyds Pharmacy brand and the requirements of modern consumers. A planning application for the new shopfront and signage was submitted to Cherwell District Council at the end of 2012.  
 
The application was refused by Cherwell DC early this year. The refused was further complicated as Lloyds Pharmacy had - against our professional advice - begun works and replaced the shop front with the modern design.    
 
Lloyds Pharmacy was therefore at risk of enforcement action by the Council which would have forced them to remove the new shop front and reinstate the original frontage at great expense.  
 
At this point we carefully reviewed the planning officer’s report which summarised his concerns and reasoning for refusing the application. One of the main reasons cited for the refusal of the application was the impact the proposed frontage was considered to have on the Conservation Area and surrounding listed buildings.  
 
However, the Council’s Conservation Officers had not been consulted and we felt that there were robust grounds for an appeal. On the instruction of Lloyds Pharmacy, we appealed the Council’s decision by written submission in March of this year, challenging their decision to refuse the application. Confirmation of the appeal’s success was received in July of this year. 
 
Our appeal statement was based on detailed examination of the planning officer’s report by which revealed the weaknesses and inconsistences in the Council’s decision which ultimately resulted in a successful appeal. The new shop frontage now benefits from full planning consent and will continue to attract customers from Bicester historic centre for many years to come.
