Description


Lot 1
About 52.80 acres of predominantly grassland, but which includes about 2.44 of wooded areas. There is excellent access off New Works Lane which leads to concrete and hardcore yard areas.


The purchaser of Lot 1 will be responsible for maintaining the boundary structure between points A and B in a stock proof condition.


There may be planning potential for equestrian or agricultural development subject to planning permission. All planning enquiries should be directed to the local planning authority, Telford and Wrekin Council.


Lot 2
About 15.55 acres of grassland divided into two main enclosures. This lot is accessed via a right of way over an initial 40 metre section of an access track which is included within Lot 3 and which leads off New Works Lane with maintenance liability according to user. The purchaser of Lot 2 will be responsible for the cost and works to install any additional gateway off the first 40m of access track. A footpath crosses the northern section of Lot 2.


The purchaser of Lot 2 will be responsible for maintaining the boundary structure between points C and D.


Lot 3
About 25.43 acres of predominantly grassland, but which includes tracks and about 1.33 acres of wooded areas. The land is divided into three main areas.


Lot 3 includes an access track leading off New Works Lane. If sold in lots, the purchaser of Lot 2 and the vendor will have an unrestricted right of way with vehicles over the first 40 metres of the track, along with the right to install gateways leading into adjoining land. Bridleways and public footpaths cross Lot 3.


Designations
The bulk of Lot 3, and the very northern-most section of Lot 2 lie within the Shropshire Hills Area of Outstanding Natural Beauty. The majority of the land is designated as a surface water Nitrate Vulnerable Zone.


Coal Mining & Aftercare
The majority of the land was previously opencast mined for coal and has now been restored to agricultural use. We understand that restoration of the land was signed off by the Mineral Planning Authority on 28 April 2015. The land was then subject to a 5-year statutory Aftercare Management period which ran from 21 April 2015 to 21 April 2020. Following the Aftercare Management period the land is to be managed in line with the Habitat Management Plan for a further period of 10 years; to 21 April 2030. A copy of both the approved Aftercare Management Plan (Restoration and Aftercare Strategy), the approved Habitat Management Plan and the unilateral obligation are available from Fisher German. All obligations under the Aftercare Management Plan, Habitat Management Plan and unilateral obligation will be passed to the purchasers. We are aware that a portion of Lot 1 has previously been landfilled and understand that this activity ceased in the 1980s. Overage
The property is sold subject to a pre-existing overage clause whereby 50% of any uplift in value on implementation or sale following the issue of planning permission for use other than agriculture or equestrian will be payable to the Vendor. Cross Rights
If sold in lots, cross rights and reservations will be required.


VAT
The land is elected for VAT which will be payable in addition to the purchase price.


Basic Payments Scheme
The land is registered on the Rural Land Register and is eligible to receive entitlement payments from the Basic Payment Scheme. The payment from the current scheme year will be retained by the vendor. These entitlements are not included within the sale but may be available separately.
