Government loses solar Feed-in-Tariff appeal at Supreme Court

The Supreme Court has rejected the Government’s appeal against previous High Court and Court of Appeal rulings that it unlawfully reduced Solar PV Feed-in-Tariffs (FITs). It ends months of speculation about the rates that installations fitted between 12th December 2011 and 3rd March 2012 would receive. 

The decision confirms that the original payment of 43p/kWh rather than the proposed 21p/kWh will apply to systems installed within this period.
 
Mark Newton, Head of Renewable Energy at Fisher German, believes this latest outcomes has finally cleared up the uncertainty within the solar PV industry and provides closure for many thousands of people who installed this technology between 12th December and 3rd March.
 
“This is an excellent outcome for those who have installed before 3rd March and I am glad to see that a decision has been made that will end months of speculation. I hope that know we can put this behind us and that people throughout the country can once again have confidence installing renewable energy projects.

“Even at the current lower FIT rate of 21p/kWh, solar PV is an excellent investment opportunity for those that want energy security and a secured income for the next 25 years. I would recommend that those looking to install solar PV should do so as soon as possible as the price of solar PV has come down dramatically since 12th December and will be reduced again on 1st July."
