Bats - newts - dormice? Watch out!

habitatFollowing the UK being taken to court by the EU, the 1994 Habitat Directives have been amended. Effective from 21 August 2007 it is an offence to ‘damage or destroy a breeding site or resting place of a European Protected Species (EPS)’ - even inadvertently! A blind eye to any contraventions of the new amendment is being observed until March 2008.

One must work within good practice guidance if undertaking works; these requirements are too exhaustive to list here! Otherwise a licence must be obtained from English Nature (commonly through the Forestry Commission) for any work to be done to avoid a fine or imprisonment!

Incidentally this legislation is autonomous from health and safety requirements. Should a dangerous tree need felling, known to harbour bats or other EPS’s, Forestry Commission advice at a recent seminar was to contact English Nature in the first instance!
