Non-Negotiable Telecom Leases

The long-awaited main launch of 3G mobile phone services is now rolling out fast and a leading firm of Chartered Surveyors, with specialists working in this field, warns that this could result in property owners losing out.

Mark Newton from the Fisher German Telecoms Department explains that agents acquiring mast sites for the new 3G mobile phone systems often say terms are non-negotiable. 

Mark is urging owners to seek professional valuation and negotiation advice to ensure their interests are protected in the long term: Sometimes the Operator's agents state that terms are non-negotiable to speed up their acquisition of a site and to achieve bonuses, but in many cases terms can be improved.

Mark continues: 'The Operators will be seeking a long term lease and therefore it is vital for owners to ensure that they protect their future interests as much as possible.'

Fisher German's Telecoms Division has consistently improved non-negotiable terms using its nationwide experience in this specialist area.  Mark says:  'It is important to ensure that the rent is at least comparable with other agreements.  There are few things worse than thinking you have a good deal, only to find a mile up the road someone is receiving a higher rent for a similar site.  At Fisher German we have over 3,000 comparable sites on our database.'
