The Waste Management (England and Wales) Regulations 2006 ‘The Agricultural Waste Regulations’

wasteAs you maybe aware these regulations came into force in on the 15 May 2006, the government gave all landowners and farmers a 12 month transitional period to the 15 May 2007, therefore time is running out for farmers and landowners to register for the exemption, which enable the farmer to carry out a whole range of tasks which will be banned under the Waste Management Regulations 2006. Three golden rules to adhere to are Don’t Burn, Don’t Bury and Duty of Care.

 

Waste is defined as:
“Any substance or object which the holder discards or intends to discard or is required to discard”.


It is left to the Holders/Farmers discretion as to what they deem to be waste the questions that need to be asked are who’s got it? Where it is? and What are the Intentions for it?

 

From the 15 May 2007 the following must be adhered to:


Rule One – Uncontrolled open burning of waste will be illegal;
Rule Two – The continued use of ‘farm-dumps’ or ‘farm-tips’ for waste disposal will be illegal;
Rule Three – Everybody has a Duty of Care, to keep waste safe and secure, especially when transferring off farms;
Rule Four – Exemptions are available but must be registered before 15 May
2007.

 

The exemptions are free to apply for and are effective as soon as the form has been sent to the Environmental Agency. Waste can be stored on site for 12 months before it is removed from site to be disposed of in the correct manner. To be removed off site the contractor who is removing it must be a registered carrier and transfer note must be completed and retained to show that the waste has been disposed in the correct manner.
