Telecoms mastFollowing the emergence of the main telecoms market, almost 10 years ago, a large number of leases for telecoms sites are now due for renewal. In addition, the rental on many sites will be coming towards their three or five-year review.

Mark Newton, general practice manager and telecoms specialist at Fisher German, Market Harborough explains how both of these events give landowners the opportunity to significantly increase returns on their lease and rental agreements.

As rents for some telecoms sites were agreed at historically low levels, we are still achieving a number of substantial increases – with £35,000 per annum the highest recently negotiated for a rooftop site.

We recommend that in all telecoms rental and lease negotiations it is important for people to seek professional advice at the earliest opportunity. Those who do not could be missing out on a substantial windfall.

For landowners with upcoming lease reviews, it is critical not to collect further rent after the end of the lease until terms have been re-negotiated. If rent is collected, a periodic lease can be created under the existing terms of the original lease, which means there is no opportunity to obtain a market rent or more modern terms in a new agreement.
